Michael Joliat’s article “No Magic Wand: Selected Problems with Reciprocity” was published in the January/February 2024 issue of Benefits Magazine. In it, Mike discusses how reciprocity agreements allow traveling workers to have employee benefit plan contributions that they earn while working outside their home plan’s jurisdiction transferred back to their home plans. He also explains how these agreements can benefit both the worker and the employer but warns that multiemployer benefit plans should be mindful of potential legal pitfalls.

Mike is a shareholder in Reinhart’s Employee Benefits Practice and Taft-Hartley Group. He primarily acts as fund counsel to multiemployer health, retirement, apprenticeship, vacation and other benefit plans. He provides plan trustees advice regarding compliance with the Employee Retirement Income Security Act (ERISA), the Internal Revenue Code, the Affordable Care Act, Health Insurance Portability and Accountability Act (HIPAA) and other federal laws and provides other services to meet the general counsel needs of employee benefit plans and their fiduciaries.
