As an experienced member of Reinhart’s Litigation Practice, Dan Murphy blends his judgment, honed by years of trying cases as a prosecutor, with strategy and his knowledge of the law to counsel and represent companies and individuals in complex legal matters. He handles a variety of matters, including ERISA and employee benefits litigation, white collar matters, health care litigation, shareholder disputes, product liability and environmental claims, and real estate litigation.

Dan leverages every aspect of his courtroom experience to position his clients for success. He strives to negotiate and anticipate challenges early in a case to deliver cost-conscious and practical results for his clients. Dan takes a proactive approach to ensure the outcome is worth the client’s investment. After trying dozens of cases to a jury, Dan is quick on his feet and confident in tense situations. In fact, he thrives in the competitive, high-stakes environment of litigation.

Dan’s time as a prosecutor in the Milwaukee County District Attorney’s Office also gives him unique insight into how the government investigates civil and criminal violations and, ultimately, prosecutes a case. He is competent in both state and federal prosecutions, having worked as an intern in the U.S. Attorney’s Office and maintained many connections there.

Before law school, Dan taught high school Spanish. That experience informs Dan’s approach to his work as an attorney. He spends the time to reach the other side in a dispute, educating them about his client’s position and conveying his appreciation of their position.

Dan has a network of strong connections in the Wisconsin legal community. He comes from a long line of attorneys and his mom served as a trial and appellate court judge. Dan is also active in the Milwaukee Bar Association and a member of Inns of Court, a practitioner group that promotes professionalism and mentoring of rising attorneys. He draws on this extensive network to keep informed about developments in the law and for guidance on how to excel as an attorney.

In what little free time he has as a parent of two young kids, Dan enjoys running, playing golf and cycling. He recently took his interest in cycling to the next level, participating in the Trek 100 Ride to raise money for childhood cancer research. Dan also gives back to the community. He serves on a committee for Centro Legal, an organization which provides low- and no-cost legal services in the Milwaukee area.

Matters

  • Counseled client on exposure resulting from employee’s alleged criminal acts and facilitated internal investigation as well as cooperation with law enforcement.
  • Obtained dismissal of employer’s suit contesting obligation to make interim payments on withdrawal liability, ensuring the pension fund would receive payment while parties disputed employer’s withdrawal liability.
  • Won summary judgment in heavy machinery breach of warranty suit reducing the client exposure from roughly $5 million to $500,000.
  • Secured favorable arbitration award, including an award of attorneys’ fees, in shareholder dispute over directors’ breach of fiduciary duty and breach of entity’s operating agreement.
