Overview
As a mediator, Mark leverages more than 40 years of private and public sector litigation experience in the civil and criminal areas, successfully litigating and settling many complex matters. Central to his philosophy and core values as a neutral is a commitment to having a granular understanding of the case at hand—its facts and governing law. He works collaboratively with internal resources at the firm to enter the process exceptionally prepared. He couples this preparation with a keen sense of claim valuation and litigative risk—thus being able to facilitate the parties’ understanding of the same and thereby maximize the probability of a successful mediated settlement. This process promises the greatest chance of success in even the most contentious and complicated cases, where parties have previously been unable to extricate themselves from intractable litigating/settlement positions.
Mark works most cases with the benefit of internal firm partners with specialized substantive expertise. And because his fees are fixed, the parties enjoy the benefits of his access to those partners without additional cost. Examples of areas he mediates include securities, intellectual property, ERISA and various causes of action based in fraud. Mark’s access to subject specific perspectives allows him to focus the parties on the actual risk/reward calculus they face at trial. His extensive trial experience enables him to easily grasp the governing law and salient facts of the disputed claims, assuring the parties know their case is understood and considered with care and without bias.
Reinhart—Mark’s home firm—has comfortable facilities to provide a neutral environment located centrally in the country with easy access by air travel. Reinhart can accommodate onsite matters with multiple parties, and it is near upscale and middle-market lodging choices. Mark will always consider travelling to a location jointly requested by the parties.
Mark’s fees are transparent and without the administrative fees and costs (often substantial ones) associated with large dispute resolution organizations. His mediations are done on a fixed fee basis and allow for the mediator’s continued involvement post-mediation date based on an hourly rate. However, his fixed fee includes all pre-mediation preparation and conferences with the parties so that the day of mediation can be best utilized. Travel and lodging expenses, if appliable, are an additional charge. Pre-payment is required according to arrangements set forth in the engagement.
