Recognizing trends in the business environment, coupled with a desire to serve clients more holistically, Reinhart Boerner Van Deuren became the first major Wisconsin law firm to establish a separate business insolvency practice in the early 1980s. Since that time, Reinhart attorneys have played a significant role in virtually every major bankruptcy proceeding in Wisconsin, as well as many bankruptcy proceedings outside of the state, and have established a strong reputation and proven track record of success in insolvency matters. Reinhart’s Business Reorganization attorneys regularly represent a wide variety of parties in all aspects of insolvency law at the state and federal level, including lenders, borrowers, creditors, debtors, committees, trustees, receivers, landlords, buyers, sellers, shareholders and other equity holders and bondholders. We regularly represent clients in reorganizations of businesses with annual revenue of up to $300 million or more.

We represent lenders, debtors, committees, DIP lenders, landlords, unsecured creditors, trustees, bondholders, equity holders, contract parties, professional advisors, receivers and various other parties-in-interest in bankruptcy proceedings, receiverships and other insolvency proceedings. These engagements encompass every aspect of insolvency proceedings, including reorganizations, liquidations, asset sales, DIP financing, avoidance actions, including preference and fraudulent transfer actions, other adversary proceedings and claims prosecution and transfers. In addition to federal insolvency proceedings, we frequently advise parties in state and federal receiverships. 

Reinhart’s Business Reorganization attorneys have a wide range of experience in out-of-court restructurings and workouts and are adept at dealing with the diverse and often competing interests of the various constituencies involved in these types of transactions. We regularly represent money center and international financial institutions and other lenders, borrowers, creditors and equity holders to restructure debt and equity to provide maximum recoveries for creditors, while preserving the viability of the business. We routinely work with members of the firm’s Banking and Finance group to counsel clients about limiting credit risk through advantageous documentation and credit facility structuring, as well as providing representation after borrower default and insolvency.  

Our Business Reorganization attorneys have developed a very active practice in the acquisition and sale of businesses and assets out of distressed situations. We bring an expertise in both insolvency and transactional law to the table, along with vast experience in negotiating, structuring and documenting distressed transactions.

  • Represented Air Wisconsin Airlines, Inc., one of  nation’s largest regional airlines, as a $125 million Junior Debtor in Possession Lender  in the US Airways Chapter 11 case.
  • Successfully represented Bankers Bank, as lead lender to 80 member bank group, in connection with its $120 million claim in the Chapter 11 case of Renew Energy, Inc., one of Wisconsin’s largest ethanol producers.
  • Represented one of largest cheese company’s in the Eastern United States in a $150 million sale to one of Canada’s largest cheese companies.
  • Successfully represented one of Wisconsin’s largest paper converting machine companies in its sale to a large Midwest purchaser.
