Robert S. Driscoll is an attorney in the firm's Labor and Employment Practice.
 

Prior to joining the firm, Rob was a law clerk for the Honorable Diane S. Sykes, U.S. Court of Appeals for the Seventh Circuit in Milwaukee, Wisconsin. 

Representative Matters and Experience

  • Defending employers against claims of unlawful discrimination and/or retaliation by current or former employees
  • General employment litigation, including disputes over restrictive covenants between employers and former employees
  • Drafting non-competition agreements and other restrictive covenants
  • Appeals in both the federal and state courts
  • Defending unionized employers in labor arbitrations
  • Defending property owners and management agents against claims under the federal Fair Housing Act and state fair-housing laws 

Many of Rob's cases have resulted in reported decisions. Here are some examples:

  • InfoCorp, LLC v. Hunt, 2010 WI App 3, 323 Wis. 2d 45, 780 N.W.2d 178 (holding that under Wisconsin law, employees owe a duty of loyalty to their employers)  
  • United States of America and Richard Singsime v. WHPC-DWR, LLC et al., No. 0–CV–0590, 2011 WL 6817921 (E.D. Wis. Dec. 28, 2011) (holding that defendants did not violate the federal Fair Housing Act)
  • Reliable Fire Equipment Company v. Arredondo, et al., No.  111871, 2011 WL 6000743 (Ill. Dec. 1 2011) (clarifying the standard that Illinois courts must use when evaluating the enforceability of restrictive covenants between employers and employees)
