Rebecca Frihart Kennedy, a shareholder in the firm's Litigation Practice, represents corporations ranging from financial institutions to consumer product and heavy machinery manufacturers in wide range of complex civil litigation matters. She has litigated cases at both the trial and appellate levels in both state and federal court and also regularly serves as local counsel in Wisconsin state courts as well as the United States District Courts for both the Eastern and Western Districts of Wisconsin. Rebecca has focused her practice primarily in the areas of products liability, fiduciary liability, civil fraud and general commercial and contract litigation.

Rebecca maintains an active pro bono practice. She assists victims of domestic abuse obtain restraining orders, is a regular volunteer at the Marquette Volunteer Legal Clinic and has been appointed as counsel by the United States District Court for the Western District of Wisconsin in an Eighth Amendment section 1983 action.

Rebecca joined the firm after serving as a judicial law clerk for two years to judge Barbara B. Crabb of the United States District Court for the Western District of Wisconsin.

Representative Matters and Experience

  • Winning summary judgment on behalf of a railroad in a dispute with a competing railroad regarding line use rights
  • Representing a financial institution in an action to recover on a loan made to a Native American Tribe and tribal corporation
  • Representing manufacturers and distributors in strict liability and breach of warranty actions
  • Working with a team of attorneys to obtain a favorable jury verdict and injunctive relief in favor of a commercial real estate developer in a case involving complex environmental claims against a municipal sewerage district
  • Winning summary judgment in a Title VII retaliation claim brought by the EEOC
  • Winning summary judgment in an ADA discrimination action
  • Briefing a successful appeal to the Wisconsin Supreme Court challenging the constitutionality of a statute related to state termination of parental rights
